Summary

This privacy statement describes how we handle information we receive about you as a result of your visit to our learning platform. The learning platform learning.dehn.de is operated by DEHN SE + Co KG. This privacy statement is based on the EU General Data Protection Regulation (GDPR). As it was issued by the European Union (EU), the GDPR is important to us. Companies within the European Union and the European Economic Area (EEA) are required to comply with the GDPR. Accordingly, this Privacy Statement is based on GDPR standards.

Full policy

The learning platform is used for conducting training sessions for our customers, partners and employees. By using the platform, you allow us to store personal information about you. This information includes your name and e-mail address, the courses you use, what you did in these courses and when. Performance scores from the courses (e.g. test results) are also stored. This information can be associated with your identity. We are therefore required to inform you that these data are being compiled and processed and to inform you of your rights in this regard.

Internal access to personal data
We ensure that your data are only internally accessible to those people who absolutely require access to it. Personal data will be kept confidential and not made publicly available. Most data are information you enter yourself. Thus, this information is already known to you. Other data are generated automatically through the evaluation of tests and exercises. In addition, your use of the site is automatically logged and recorded on the server. These logs are used to resolve technical issues.

Third-party access to personal data
In conjunction with server maintenance, administration and security audits, external service providers are given temporary confidential access to personal data.

Information on profiling
We do not conduct any profiling as defined by the General Data Protection Regulation. In conjunction with courses, tests may be used as a basis for demonstrating the qualifications required to complete a course. Test performance is assessed automatically. The test questions are compiled by people for each individual course.

Processing of personal data and legitimate interests as per GDPR
The data collected are processed to produce proof that a course has been carried out and completed. They are also evaluated for the purpose of improving the training courses.

Term of storage or criteria for the term of storage
The data in your user profile are stored until the user profile is deleted. The data from participating in a course are stored until the course is deleted. Course final test results and an overall score are stored until the legal retention obligations expire.

Rights of the data subject
In conjunction with the applicable data privacy regulations and to the extent provided for therein (e.g. under the GDPR), you have a number of rights over the controller and with regard to your personal data. These includes:

> The right to be informed by the controller(s) (see below) of the information they store about you. You can view this information at any time by logging into the platform.
> Right to rectification. If incorrect information is stored, you can currently modify it yourself (profile data you enter yourself) or request that the controller modify it. The controller will comply with such requests, as long as the rectification is justified and reasonable.
> Right to deletion. You are entitled to have the controller delete any data about you which is factually incorrect or which the controller no longer needs. The right to deletion does not apply if the controller is obligated to retain the data (proof of training, proof of quality control, rights of use) for legal reasons or based on other obligations (e.g. contracts with customers). The obligation to store data may still apply after the employment relationship is terminated. > Right to restrict processing. In case of restriction, the controller must ensure that the data are only accessible to those people who absolutely require access to it.
> Right to opt out. You have the right to object to further use of your data. This right only applies with future effect. The right to opt out does not automatically obligate the controller to delete the data. If the controller is obligated to retain the data for other reasons, he/she must assess this and inform you accordingly. Opting out can result in you losing access to the learning platform.
> Right to data transmission. You have the right to have the controller provide you with a record of the data submitted by you in a conventional electronic format which can be used by other parties. This right is limited to data which is not subject to company confidentiality and therefore cannot be shared with other parties or data pertaining to the rights of others, e.g. copyright.

However, please note that we also reserve the right to use the legally afforded restrictions, e.g. if we are obligated to retain or process certain data, if we have an overriding interest in doing so (provided we are entitled to invoke this right) or if we need it in order to assert claims. We will inform you of any costs potentially incurred by you.

Generally, as a prerequisite for asserting such rights, you must clearly identify yourself (e.g. with a copy of your ID if your identity is not otherwise clear or cannot otherwise be confirmed).

Any data subject furthermore has the right to assert their claims in court or file a complaint with the responsible data protection authority. The responsible data protection authority is the Data Protection Authority of Bavaria for the Private Sector(BayLDA).

Automatically stored non-personal data and scope of processing
When you log into the learning platform, we save certain information for administrative and technical purposes.

This information is:

> type and version of the browser used<
> operating system used
> referrer URL
> host name of the accessing computer
> data and time of access

These data are anonymised and used only for statistical purposes or for the purpose of improving our internet and online services. These anonymised data are saved (separately from personal data) on secure systems and cannot be associated with any individual person. This means that your personal data are protected at all times. It is absolutely necessary to log data in order to provide the website and to store data in logfiles in order to operate the website. The user has no option to opt out.

Use of cookies
Our learning platform uses cookies. Cookies are text files which are stored in the web browser or which the web browser stores on the user’s computer system. When a user visits a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic string that allows for the browser to be uniquely identified upon a repeat visit to the site.

As a user, you have full control over the use of cookies. You can disable or restrict the transfer of cookies by changing the settings in your web browser. Previously stored cookies can be deleted at any time. This can also be done automatically.

The purpose of technically necessary cookies is to make the site easier to use. Some functions of our site cannot be provided without the use of cookies. These functions require that the browser continue to be recognized after the user leaves a page. The user data collected by technically necessary cookies are not used for the purpose of creating user profiles.

Our learning platform requires the following cookies:

> Moodle Session
This cookie must be allowed in order to keep you logged in as you move from page to page. When you log out or close your browser, the cookie is automatically deleted.
> Moodle ID 
This cookie saves the login name in the browser and is retained after the user logs out. This way, the next time you log in, your login name is already entered. This cookie is enabled if you select “remember login name” in the login screen and is retained as long as “remember login name” is selected. If you uncheck the box before logging in, this cookie will be deleted automatically.
> Google Fonts
This site uses fonts provided by Google Fonts. Google Fonts is a service of Google Inc. ('Google'). These web fonts are incorporated via server call, typically a server belonging to Google in the US. As a result, the server is informed of which of our webpages you have visited. The IP address of the site visitor’s device browser is also stored by Google.
